Article 49 of the general Law for the Protection of Consumers and Users has given enforcement powers to the Spanish Authorities in order to punish those corporations that used unfair terms in consumer contracts. It is a measure that tries to protect the general interests of the consumers. However, it has little application in comparison to the judicial approach. This paper has two main objectives. On one hand it analyses the reasons that could explain the limited application of the Spanish administrative control. On the other hand, it examines the model of preventive control stablished in the United Kingdom in 1999; which results a more effective way of protecting consumers in relation to unfair terms.
