Resumen:
The author presents legal commentary on "Apostolic Letter 'Motu Proprio' Ominem Mentem of the Supreme Pontiff Benedict XVI on Several Amendments to the Code of Canon Law" issued by the Holy See, with a focus on analysis of amendments to canonical provisions pertaining to formal acts of defection from of the Catholic Church. He first examines relevant legal background documents, including the "Tametsi" decree of the Council of Trent, the "Matrimonia quae in locis" declaration, and the second clause of canon 1099 of the 1917 Code of Canon Law. He then addresses the treatment of formal acts of defection in Church doctrine, the difficulty of conceiving of formal defection as a legal act, and formal defection as a positive act of true abandonment.
