Der Artikel ist ein erster Kommentar zu der neuen Apostolischen Konstitution über die Reform der Römischen Kurie ¿Praedicate Evangelium¿. Ausgehend von den Vorarbeiten zu dem Dokument gibt der Autor erste rekonstruierende Einblicke in dessen Inhalt.

El texto se ocupa en su primera parte del marco jurídico canónico de organización y gobierno que debería valorarse en sede judicial ante la eventual responsabilidad penal de los entes eclesiásticos, sobre todo de las diócesis y las parroquias. La segunda parte valora los inconvenientes y las ventajas que supondría la aplicación de la figura del compliance officer a los entes eclesiásticos.

The article deals with the incidence of two factors in ecclesiastical offices: the passage of time and the fulfilment of certain age limits in the holder of the office. The first part of the study presents a systematic summary of the general legislation. The second part discusses the novelties and consequences of the treatment of the temporal factor of offices in the regulations published in 2021 by the Dicastery for Laity, Family and Life. The study concludes with an assessment of the norms of the Dicastery's decree with regard to the fundamental freedom of association in the Church.

A commentary on the recent norms of Pope Francis on the Synod of Bishops is presented. Episcopalis communio has not properly promoted a refoundation but rather a transformation of the Synod. The most important question that arises now is the adequate coexistence in the same institution of the principle of episcopal collegiality with the criterion of synodality.

El artículo estudia los precedentes históricos del oficio eclesiástico, una figura prevista por las normas generales del ordenamiento canónico. Se presentan aquí las referencias al oficio en el derecho romano y en las principales fuentes del derecho canónico medieval. En la segunda parte del estudio son examinados tres aspectos que configuran el contenido de la noción de oficio en su evolución histórica; a saber: su vinculación con la potestad eclesiástica, su alcance y significado institucional, más allá de la sucesión de personas individuales, y finalmente su relación histórica e interdependiente con la institución del beneficio eclesiástico.

The Episcopal conference is an institution that has gone through different stages since its origins in the nineteenth century. At present, given the doctrine of the synodality of the Church, there is some discussion of whether Episcopal conferences should be recognized as having general authority over the dioceses of the nation. This paper addresses the arguments for and against this possibility, and the importance of the «predominantly» consultative function of the Episcopal conference is recalled.

El oficio es regulado por las normas generales del derecho canónico (CIC, c. 145; CCEO, c. 936). Inspirado en el derecho romano y renovado por la tradición cristiana, es un elemento básico del sistema institucional de la Iglesia católica. En este libro se ofrece una síntesis de las principales cuestiones que afectan a los cargos públicos eclesiásticos. Algunas de ellas son tradicionales, pero otras, como la responsabilidad, la idoneidad y los sistemas de contratación, han cobrado actualidad desde que el acceso al oficio eclesiástico haya dejado de estar reservado a los clérigos. Al tratarse de una institución general del ordenamiento, el estudio del oficio permite asomarse a las grandes cuestiones del derecho canónico, como son la relación entre oficio, comunidad y potestad, la posición del oficio en la estructura pastoral y de gobierno, y los diferentes instrumentos para la provisión y cesación en los cargos. Por eso se puede afirmar que conocer el ius canonicum sobre el oficio ayuda a conocer mejor la Iglesia considerada como comunión.
