    Resumen
    This study analyses the impact of Oswald Spengler's (1880-1936) work in Spain during the interwar period. It proceeds with three steps as follows: The first part (II) investigates the reception of Spengler's historic morphology of cultures in the so-called circle of the Revista de Occidente. The second part (III) delves into the early echo of Spengler's work among the Spanish left up to the Second Spanish Republic. The third part (IV) focuses on the impact of Spengler's historic morphology among conservative traditionalists and members of the radical right prior to the Spanish Civil War. This analysis point towards broad, transideological debate on Spengler in Spain that the Spanish right then usurped and radicalised during the 1930s.

    Resumen
    El pluralismo religioso actual ha sido clave para revisar tanto el concepto de secularización como el de libertad religiosa. Asistimos a una vuelta a lo sagrado. No se ha cumplido la tesis de la secularización ilustrada: la religión desaparecería de la esfera pública con el progreso de la ciencia. Sin embargo, el resurgimiento religioso significa, de una parte, la presencia en el espacio público de la religión tradicional institucional junto a formas de espiritualidad narcisistas; de otra parte, que es necesario revisar qué se entiende por religión y mostrar el porqué la fe religiosa es un bien que ha de ser protegido jurídicamente.

    Resumen
    What is the classic in history? What is a classic in historical writing? Very few historians and critics have addressed these questions, and when they have done so, it has been only in a cursory manner. These are queries that require some explanation regarding historical texts because of their peculiar ambivalence between science and art, content and form, sources and imagination, scientific and narrative language. Based on some examples of the Western historiographical tradition, I discuss in this article to what extent historians should engage the concept of the classic - as has been done for literary texts. If one assumes that the historical text is not only a referential account but also a narrative analogous to literary texts, then the concept of the classic becomes one of the keys for understanding the historical text - and may improve our understanding not only of historiography, but of history itself. I will argue in this article that it is possible to identify a category of the classic text in some historical writings, precisely because of the literarity they possess without losing their specific historical condition. Because of their narrative condition, historical texts share some of the features assigned to literary texts - that is, endurance, timelessness, universal meaningfulness, resistance to historical criticism, susceptibility to multiple interpretations, and ability to function as models. Yet, since historical texts do not construct imaginary worlds but reflect external realities, they also have to achieve some specific features according to this referential content - that is, surplus of meaning, historical use of metaphors, effect of contemporaneity without damaging the pastness of the past, and a certain appropriation of literariness. Without seeking to be normative or systematic, this article focuses on some specific features of the historical classic, offering a series of reflections to open rather than try to close a debate on this complex topic.

    Resumen
    This article analyses the similarities between public international law and canon law in the legal treatment of the human person. International and canon law endowed the legal concept of person with an overly technical and reductionist meaning. This reductionist conception of the person has prevented the proper development of both canon law and international law. However, just as international law today has rectified its course and is gradually becoming a global law, increasingly focused on the human person, so too canon law, to fulfill its evangelising purpose, should be globalised. The globalisation of canon law subordinates the centrality of the already baptised Christian and, instead, prioritises the centrality of every human person created in the image of God and called to be regenerated in the baptismal waters.

    Resumen
    Based on the interest aroused by royal funerals at the end of the Middle Ages, this paper analyses the obsequies held in the Eternal City on the occasion of the death of Isabella the Catholic (1474¿1504)¿Queen of Castile and Aragon¿in a context of international tension and succession unrest. The papal diaries, diplomatic documentation and Ludovico Bruno¿s sermo funebris allow us to reconstruct the liturgical, scenographic and rhetorical display of a ceremony that seduced with its solemnity and elegance, the fruit of a hybridism that combined Spanish and Italian funerary traditions in the Rome of Julius II. The creativity of the Spanish community is thus evident in its ability to convert the Isabelline funeral ceremony into an expression of dynastic power in the context of Spanish¿French competition and incipient tensions between the Habsburg and Fernandine courts over the Castilian succession. Only by starting from this intertwining of the political and the liturgical will we be able to understand the transformations undergone by the funeral ceremonial in its passage¿still little explored¿from late medieval customs to modern scenographies.

    Resumen
    Esta recensión colectiva analiza cuatro importantes obras recientes publicadas en torno a la segunda escolástica española, y más específicamente sobre la Escuela de Salamanca. El autor defiende que la Escuela de Salamanca irradia todavía luz sobre cuestiones tan actuales como los derechos humanos, la igualdad de todos los seres humanos, la autonomía del poder civil, la existencia de una comunidad humana global y la necesidad de entendimiento entre los pueblos. En el estudio actual de la Escuela de Salamanca, sin embargo, se echa en falta una mayor coordinación internacional entre todas las iniciativas. Se debe seguir trabajando para superar ciertas barreras culturales, especialmente idiomáticas y para mejorar la capacidad de integrar las diversas perspectivas desde las que aproximarse a este movimiento cultural. La Escuela de Salamanca debe analizarse holónicamente, es decir, como parte y como todo: como una parte de un movimiento más amplio llamado escolasticismo, que promociona un método de estudio concreto, y como un todo autónomo que surge en Salamanca. Excluir cualquiera de los enfoques posibles, como insinúan algunos autores, más que conducir a la precisión intelectual, supone una limitación del conocimiento. La unidad de la realidad demanda unidad en el saber.

    Resumen
    En este artículo, se analizan algunos aspectos de la teoría realista del derecho del jurista español Javier Hervada (1934-2020), quien, inspirado en los juristas romanos y Tomás de Aquino, entre otros, concibe el derecho como la cosa justa. En el artículo, se explica el significado romano de la palabra ius, el sentido de las expresiones ius suum y res justa y su papel en la elaboración doctrinal de Hervada. El artículo también analiza la definición que ofrece Hervada de ley como regla o medida del derecho, así como su aproximación a la idea de persona como ser que se pertenece a sí mismo. El artículo concluye que la teoría realista de Hervada constituye una interesante aproximación al derecho como objeto de la virtud de la justicia. Pero ni el derecho puede reducirse a mero objeto de la virtud de la justicia, ni la justicia puede tratarse solo como una virtud.

    Resumen
    The idea of solidarity is in vogue, especially since the eruption of the COVID-19 pandemic. However, the term "solidarity," as used in nursing, is imprecise and vague, lacking clear definition and connoting a variety of general meanings. Based on the original meaning of "solidarity" in ancient Roman law, this article captures the archetypical idea of solidarity from a historical and interdisciplinary perspective. This archetypical or primary meaning comes before the development of any other meanings of the word, and it is therefore authentic and genuine because it does not derive from something else. After establishing the archetypical meaning of solidarity, the article translates this meaning into the area of nursing and demonstrates a deep connectivity between healthcare and solidarity. The second part of the article offers and develops a new definition of nursing solidarity as the responsibility for the healthcare of a person (unit) shared as a whole (entirety) by that person and a nurse or a nursing team (plurality). This new definition has some implications for nursing practice and education, since the definition emphasizes the idea that solidarity helps to (a) foster respect and avoid discrimination, (b) promote cohesion in health communities, (c) increase individual responsibility and a spirit of service, (d) stimulate motivation, (e) improve communication, (f) create an engaging workplace, and (g) develop leadership.

    Resumen
    This article reconstructs the trajectory of Jaime Serra (c. 1427-1517), a Valencian ecclesiastic and "maestro teologo" who served the Borja family, reaching the highest positions in the Curia as cardinal and governor under four successive popes. A confidant of the vice-chancellor Rodrigo de Borja later Alexander VI he was sent to the Iberian Peninsula to oversee the affairs of the Duke of Gandia (1483-1496), and then to Umbria and Romagna to restore papal authority (1499-1503). Of robust constitution and gifted with a clever if hard tongue, the Cardinal proved himself to be an effective ruler, even if his moral reputation suffered from his female company. Despite sporadic misunderstandings with Julius II, he adapted to post-Borgian Rome, helping. Pope della Rovere in the schismatic crisis, and Leo X in his ascent to the throne he himself had toyed with that goal during the first balloting of 1513. Politically he opted for the Spanish and Venetian alliance, while maintaining a friendly relationship with Ferdinand the Catholic, which showed up especially in his promoting the African campaign and exalting its triumphs. His ecclesiastical benefits allowed him to promote notable prelates, and to maintain a household close to a hundred people who led a festive and literary life animated by humanists (Marcellino Verardi, Baltasar del Rio) and playwrights of the caliber of Juan del Encina. His patronage places him at the forefront of the cardinals who consolidated Spanish power in the Eternal City, and contributed to enhancing the prestige of Spanish letters, neo-Latin literature and artistic forms of the Roman Renaissance which may be seen in the Chapel of Santiago founded by him.

    Resumen
    Abstract: Following its colonial project, Western Europe imposed a political and cultural understanding of state nationalism and religious homogeneity on the entire world in the nineteenth and twentieth centuries. In parallel with this twofold process, ¿Religious Nationalism¿ emerged during the Cold War, affecting the Middle East and framing an updated Abrahamic version of religious Supremacism: Wahhabi Islam, the Iranian Revolution and Israeli Orthodox Judaism were politically backed, becoming the frontrunners of a new Global-Religious narrative of conflict. This article aims to critically analyse the Western-Islamic manipulation of ¿Jihadism¿ as an artificial and fabricated product, starting from the ¿deconstruction¿ of Jihad-Jihadism as an anti-hegemonic narrative. The anti-colonial ¿Islamic¿ framework of resistance to the Empire (United States) has effectively adopted the same colonial methodology: using violence and sectarianism in trying to reach its goals. Is the Islamic Supremacist ¿narrative¿ more influenced by Western thought than by a real understanding of Islam? At the same time, this article aims to stress the historical reasons why the Arab world has been artificially affected by a peculiar form of ¿Religious Revanchism¿ which can be understood only if O. Roy¿s Holy Ignorance dialogues with Steve Biko¿s Consciousness in emphasizing the need for an updated Islamic Liberation Theology.

    La historiografía de la Inquisición ha reconocido en los procesos de Córdoba y sus convulsiones sociales la crisis más grave sufrida por el Tribunal entre 1504 y 1508. Partiendo de un trabajo anterior sobre las implicaciones del fenómeno en la pugna sucesoria de Fernando el Católico y Felipe I de Castilla (1504-1506), ahora profundizamos en la evolución inquisitorial tras el fallecimiento de este último y el regreso del monarca aragonés desde Nápoles para retomar la regencia castellana (1506-1507). Gracias a la inédita correspondencia de su embajador Luis Ferrer contamos con preciosa información sobre la evolución de los procesos en Castilla, las medidas arbitradas por el Consejo Real bajo el arzobispo Cisneros, y el esfuerzo de Fernando el Católico por pacificar la tensión social y recuperar el control del Tribunal con ayuda del papado.

    Resumen
    Este trabajo estudia la política norteafricana durante los últimos años del reinado de los Reyes Católicos, la crisis dinástica y el corto reinado de Felipe el Hermoso. Un período confuso y turbulento en el que la monarquía hispánica se planteó intervenir en los sultanatos de Túnez y Tremecén para asegurar el litoral magrebí y el espacio marítimo del reino de Nápoles recién incorporado. Con documentación de archivos españoles y europeos, se comprueba cómo la basculación entre las dos zonas de expansión dependió de los intereses castellano-aragoneses y de las vicisitudes sucesorias en una línea de acción que maduró durante la regencia de Fernando el Católico.

    Resumen
    This paper analyses the vacancies and appointments of bishops in Castile in the period between the death of Philip the Fair in September 1506 and the return of Ferdinand the Catholic from Naples in August 1507. During that year, the Royal Council and the Aragonese monarch arbitrated measures to defend the Royal Patronage after Queen Juana had refused to select people to cover the vacant seats, which were disputed by nobles, clergymen and courtiers. Nevertheless, Pope Julius II demanded the appointment of the incumbents who had died in Curia. New documentation sheds light on this unique situation in the Castilian Church, which Ferdinand had to resolve in order to regain the government. He was able to achieve this with the help of Archbishop Cisneros, who was in favor of electing bishops who were good before the eyes of God and before the eyes of the people.

    Resumen
    In June 1507 Ferdinand the Catholic was magnificently received by Louis XII of France in the city of Savona (Liguria) at a meeting diplomat who surprised his contemporaries and has hardly been studied. This inaugurated the summit of two former rivals who wanted to consolidate their friendship, strengthen their monarchies and redesign the European order threatened by the King of Romans. Gathering for the first time the French, Italian and Spanish historical sources, we offer an analysis of the ritual used in its three successive stages: the arrival of the fleet Aragonese, the interview of the monarchs in the royal galley, and the procession under triumphal arches that took up the classical language of their own of modern entries. The scenery and the ceremonial displayed there allowed Louis XII to ease his diplomatic isolation, and the king Catholic to increase his prestige to recover the Castilian regency under the new ideals of peace shared with France.

    Resumen
    This article examines John Paul II's contribution to the law as a statesman, world leader and universal pastor of the Roman Catholic Church. John Paul II's approach to the law was shaped by the stark realities of having suffered firsthand the injustice of two totalitarian regimes and the cruelties of the Second World War. An ardent defender of human rights, especially the rights to life and religious liberty, John Paul II saw in the dignity of man and in human solidarity the two great levers for furthering the development of legal systems. Lastly, this article explores John Paul II's invaluable role in updating and reforming the Church's Canon Law. He had a singular role in promulgating the Code of Canon Law of 1983, the Code of Canons of the Eastern Churches of 1990, and the Apostolic Constitution Pastor Bonus of 1988 on reforming the Roman Curia organization and government. For these and other relevant legal contributions, John Paul II well deserves the title of jurist.

    Resumen
    "Muhammad is not the father of any one of your men; he is God¿s messenger and the Seal of the Prophets: God knows everything." (33:40). The deconstruction of the concept of "the Seal of the Prophets" through identifying its different spiritual-historical meanings is particularly important and partially analyzed through an inter-religious methodological approach. If indeed the Prophet Muhammad is undoubtedly the last of the prophets in order of time in the Abrahamic tradition, and thus in a literal sense "the Seal of the Prophets", the background of the 7th-century pre-urban Hijaz reflects a different cultural-economic and historical development in comparison with the Mediterranean-Mesopotamian basin. This article aims to reflect on the meanings that "the Seal of the Prophets" assumed in the Qur¿anic verse 33:40, as the adoption of different narratives to establish an Abrahamic prophetic continuity with a clear emphasis on Islamic¿Christian dialogue; the significance of these meanings reflects the opportunity for reciprocal understanding between the two most important global religions and their awareness of prophets and prophecy, i.e., on relations with God, the pact with human beings and eschatological predictions.

    Resumen
    En el siglo XIX, la idea de España como antítesis de la modernidad europea era algo más que un arma de la propaganda antiespañola, una expresión del complejo de inferioridad hispánica o un artículo del credo progresista. Era el gran tópico identitario español, compartido por todas las corrientes ideológicas, empezando por las más hispanófilas y conservadoras. Este artículo presenta diversos textos decimonónicos que atribuyen a la Reconquista la inmodernidad de los españoles, es decir, su escasa inclinación a la tolerancia, la industria, el comercio y la ciencia. Y así evidencia que los autores más dispares no solo daban por cierta esta inmodernidad, sino que la asociaban a la gesta originaria de la nación española.

Nadie podía adivinar que aquel hombre de anchas espaldas ¿muy destrozado e indispuesto¿ era César Borja, hijo del papa Alejandro VI, antiguo cardenal, capitán de las tropas pontificias y duque de Valentinois nombrado por Luis XII. El príncipe que deslumbró a Maquiavelo estaba ahora en Navarra. Y muy pocos lo sabían.

    Resumen
    This paper analyzes Jesuit pedagogy in Spain after the Second Vatican Council, encompassing recent trends and shifts by first delving into the main elements involved in the postconciliar crisis and renewal of the Society of Jesus in Spain, including the various critiques that this change received (part II). Second, this paper sheds light on the current Jesuit Ledesma-Kolvenbach University Paradigm, including its practical application and evaluation at the University of Deusto in Bilbao (part III). Third, this paper takes a brief look at the current reconsideration of active Jesuit pedagogy in Spain (and in Catalonia in particular), bearing in mind the contextualized convergences of educational philosophy (part IV). The concluding remarks address basic results from the analysis of these three elements.

    El objetivo de este artículo es analizar la reforma monástica de Fernando II de Aragón durante su primera regencia castellana (1504-1507), tras el fallecimiento de su esposa Isabel. Se trata de un período poco conocido que pretendemos iluminar con documentación ¿a veces publicada y a veces inédita¿, poniendo en relación los procesos reformadores impulsados desde la corte con la situación de las órdenes religiosas, las negociaciones con Roma, y la crisis sucesoria que enfrentó a Felipe de Habsburgo con al rey Católico. En este contexto advertiremos en qué medida el monarca aragonés se implicó en la renovación monástica, dotándole de continuidad y nuevos matices a principios del siglo XVI.

    La historiografía de la Inquisición ha reconocido en los procesos de Córdoba y sus convulsiones sociales la crisis más grave sufrida por el Tribunal entre 1504 y 1508. Partiendo de un trabajo anterior sobre las implicaciones del fenómeno en la pugna sucesoria de Fernando el Católico y Felipe I de Castilla (1504-1506), ahora profundizamos en la evolución inquisitorial tras el fallecimiento de este último y el regreso del monarca aragonés desde Nápoles para retomar la regencia castellana (1506-1507). Gracias a la inédita correspondencia de su embajador Luis Ferrer contamos con preciosa información sobre la evolución de los procesos en Castilla, las medidas arbitradas por el Consejo Real bajo el arzobispo Cisneros, y el esfuerzo de Fernando el Católico por pacificar la tensión social y recuperar el control del Tribunal con ayuda del papado.

    Resumen
    This essay offers a theoretical explanation of and a rational framework for the connection between politics and spirituality and some of the consequent implications of that connection for political life and development. It rests on the idea that empirical investigation, logical reason, and contemplative intuition are connected. They are only different epistemological approaches to the same reality, which is multidimensional but one. The unity of reality has been recognized with different nuances by various spiritual traditions, including Hinduism, Buddhism, and Taoism. In the Abrahamic religions, God, the Absolute One, is the sole creator, giver of life, and sustainer of the universe¿that is, the divine reality that upholds and supports all observable reality. But this essential distinction between a transcendent God and creatures does not necessarily exclude the unity of reality, since God permeates all material existence. God is ¿all in all,¿ says the Apostle Paul.1 Philosophers from Plotinus to Wittgenstein and mystics over the centuries have also accepted this unity of reality, which has never been denied by modern science.

    Resumen
    In this article, I explore conceptual connections between spirituality and business, and I advocate for the concept of business spirituality. I explain why the spiritual triad of love, communion, and gift is deeply related to the business triad of abundance, interaction, and resources. I also make clear why individual and collective intentions and cultural values are the main channels of interaction between business and spirituality. In the second part of the article, I argue that business evolves through spiritualization, among other ways: a) receiving meaning and purpose to business organizations; b) supporting its dematerialization; c) helping it overcome the dualism of the market; d) promoting cohesion; e) stimulating innovation; f) endorsing nonprofit institutions; g) inspiring Social Corporate Responsibility; h) encouraging spiritual leadership; i) illuminating the workplace; j) fostering respect for ethics, and k) helping it understand diversity.

    Los procesos inquisitoriales emprendidos en Córdoba a fines del reinado de Isabel la Católica provocaron una serie de turbulencias en el colectivo judeoconverso que desestabilizaron el reino de Castilla. Aunque la dimensión socio-religiosa del fenómeno ha suscitado algunos análisis, no se han explorado sus vínculos con la disputa sucesoria que enfrentó a Felipe I de Castilla ¿el Hermoso¿ y Fernando el Católico (1504-1506), ni se ha ahondado en la actitud del papado ante aquellos procesos que implicaron al arzobispo de Granada, fray Hernando de Talavera. Con documentación inédita de archivos españoles y franceses, el presente artículo estudia la pugna mantenida por ambos monarcas por el control de la Inquisición, reconstruye sus respectivas negociaciones con la Curia romana, y valora la política de Julio II para resolver la crisis evitando su politización.

    Resumen
    Since mid-nineteenth century, many Arabists and historians have referred to al-Andalus as a Muslim Spain. In the last decades, several scholars have criticized this historiographic tradition, which they see as a Hispanization of al-Andalus resulting from late-nineteenth-century nationalism. Although partly accurate, this criticism has overshadowed the fact that the success of the phrase Muslim Spain was not so much due to a Hispanization as to a de-Arabization of al-Andalus. Prior to the nineteenth century, Hispanizing al-Andalus was already a common historiographical practice: referring to the influence of the Iberian climate was enough to turn Arabs into Spaniards. The novelty of the last half of the nineteenth century was the triumph of racialism: national humors, until then attributed to geographical conditions, came to be understood as a product of biological inheritance. Thus, in order to continue Hispanizing al-Andalus, it was necessary to demonstrate (with the help of scientific anti-Semitism) that its inhabitants were not of Arabian race. And so Arab Spain became Muslim Spain.

    Desde mediados del siglo XIX, muchos arabistas e historiadores han hablado de «la España musulmana». En las últimas décadas, varios autores han criticado esta expresión, en la que ven una españolización de al-Andalus fruto del nacionalismo decimonónico. Estas críticas, aun siendo en parte certeras, han impedido advertir que el éxito de la locución «España musulmana» no se debió tanto a la españolización como a la desarabización de al-Andalus. La españolización de al-Andalus ya era habitual antes del siglo XIX: hasta bien entrada esa centuria, bastaba aludir al influjo del clima ibérico para convertir a los árabes en españoles. Lo novedoso en la segunda mitad del XIX fue el triunfo del racialismo. Los caracteres nacionales, hasta entonces vinculados casi siempre a las condiciones geográficas, pasaron a entenderse como producto de la herencia biológica. Y se hizo preciso sostener (con ayuda del antisemitismo «científico») que los pobladores de al-Andalus no fueron de «raza arábiga». Así la «España árabe» se transformó en la «España musulmana».

    El presente artículo ilumina la compleja situación de la corte tras el fallecimiento de Felipe el Hermoso, atendiendo a las facciones que se disputaron el poder bajo la reina Juana I. El análisis de la desconocida correspondencia de Luis Ferrer −embajador de Fernando el Católico en Castilla− permite reconstruir el juego de lealtades y la actuación de aristócratas, eclesiásticos y cortesanos que se alinearon en tres grandes grupos de poder: los partidarios del regreso del monarca aragonés, los defensores de Maximiliano de Habsburgo, y los hombres de la reina, empeñados en hacer respetar la autoridad de Juana entre los otros bandos antagonistas.

    This review essay discusses the historicalZeitdiagnosenin recent scholarly literature, focusing in particular on Jerome Baschet'sDefaire la tyrannie du present: Temporalites emergentes et futurs inedits(2018). Baschet's book constitutes an original contribution to ongoing debates about our temporal condition in at least three aspects. First, although relying partly on earlier theoretical literature (principally the works of Francois Hartog), it more significantly draws on the author's long-term engagement with the Zapatista movement. Second, it does not confine itself merely to diagnosing our temporal situation (presentism) but proposes strategies for exiting it. And finally, Baschet's theory of temporality is one part of his far more extensive enterprise of "exiting capitalism," a project aimed at reconceptualizing the existing foundations of Western civilization. Although previous authors have defined our contemporary regime of temporality by focusing on the present and the disappearance of the future, Baschet claims that it is more accurate to speak about a burgeoning of futures-of completely new modalities of the future that differ significantly from modernist notions of it.

    Resumen
    The law of succession addresses the legal destiny of a person¿s rights and duties after his death. Closely tied to the fundamental and peculiar features of Roman family and society, the law of succession presents vast difficulties for Roman lawyers because of its highly sophisticated nature and lack of systematic coherence. It is no coincidence that eleven out of fifty books in the Digest address the law of succession. The development of the law of succession reflects important social changes in Roman economic structures and value systems. It echoes the progression from an old Roman agrarian society to a new commercial one. From a technical legal perspective, the law of succession reveals the tension between civil law and praetorian law. Without formally altering the civil law, the praetor introduced fundamental adjustments to protect emancipated persons, blood relatives in the female line, and surviving spouses, among others.

    For Eugenio d'Ors, life is not defined by its relation to death, but as a creative principle of forms that affirms itself. In contrast, death is defined as that which is most opposed to life, a principle of destruction and negation, fatality and resistence. In this way a dialectical relationship is established between both principles, an antagonist tension which makes life a permanent fight against death. For that reason d'Ors' approach to death has an ethical and combative sense, stressing the need to live on alert.

    Durante la Transición se alcanzó un amplio acuerdo para regular las dimensiones públicas de la religión. Los tres acuerdos básicos fueron libertad religiosa, aconfesionalidad del Estado y cooperación del Estado con la más importante de las confesiones religiosas existentes en España, la católica, y con todas las demás. Los dos primeros acuerdos se alcanzaron prácticamente sin discusión, en agudo contraste con la controversia que siempre despertaron en la España contemporánea. Solo con el tercero hubo algo más de disenso, pero este se manejó también con un talante muy moderado. Este artículo hace una relectura de ese momento de la historia de España bajo la clave interpretativa del triunfo de una actitud centrista que estuvo presente en toda nuestra contemporaneidad, aunque siempre eclipsada por la intensa polarización del conflicto clerical-anticlerical.

    The article focuses in the spiritual and religious formation of first Opus Dei women. The beginning of this kind of formation was not possible in the first forties years, because of priests absence to help the founder in this task. After the ordination of three first Opus Dei priests in 1944 and others in the following years, the activities for the women formation began to be regular and similar to that developed by men. The article examinates, also, the contents of a very concrete event in this sense, as was the First Week for Work and Study about the women of Opus Dei formation, that toke place in Los Rosales in 1948.

    Resumen
    One of the central problems of contemporary political and moral thought is how to reconcile the cultural and social roots of morality with its objectivity or rational warrant, whether in the personal or political sphere. David Golemboski's reconstruction of Adam Smith's impartial spectator (European Journal of Political Theory, onlinefirst February 23rd 2015) provides a useful first approximation to this problem. What interests me is not whether Golemboski's critique of Smith's impartial spectator hits the mark, but rather, to what extent Golemboski's reconstruction of Smith's impartial spectator succeeds at addressing the problem of moral parochialism, as Golemboski claims. I shall argue in what follows that upon examination, Golemboski's reconstructed impartial spectator, far from resolving the problem of moral parochialism, actually exposes the limits of the value of impartiality as a resource for overcoming parochial prejudice, and the necessity of framing the problem of parochialism less as a matter of social and cultural bias than as a matter of the conditions of possibility of sound moral judgment.

    Resumen
    History offers the chance to act as an author and actor at the same time. It works as a great stage on which the theatre of the world plays out. The historian has the privilege of being apart from and a part of history. The historian thus functions as both author and actor, and the historical operation should always combine theoryandpractice. Theoretical reflection allows us to delve into the reality of historical authorship, connecting us to the present from which we try to access the past. Historical practice brings us closer to the protagonists of the past, trying to improve the world we live in. When historians practice both theory and practice, they are immunized from an archaeological history that is not relevant for its society as well as from a critical history conditioned by ideological, reductionist, or manipulative presentism. In this sense, being open to practicing history and theorizing the practice of history makes historians more realistic in their approaches to the past and in their theories ofhowto approach that past.

    Resumen
    This study focuses on the question of how Jesuits in Spain contributed to the deradicalisation of the ETA conflict during the 1980s. It analyses Spanish Jesuit discourses on peace and democracy in their broad historical context during the Second Cold War. The first part of this study analyses contributions on terrorism, peace, and democracy from the Spanish Jesuit journalRazon y Fe. This analysis demonstrates that Spanish Jesuits maintained significant distance from the problem of political violence in Spain long into the 1980s. Nevertheless, their efforts to present new ethical ground for peace in the context of Spain's transition were remarkable. The Jesuits' main goal has consisted in strengthening pluralism and democracy within Spanish civil society, which they understand as a precondition for any conflict mediation. The second part explores Jesuit positions on peace ethics and European security issues formulated in the context of the Jesuit instituteFe y Secularidad, which was founded in Barcelona in 1967 and has been based in Madrid since the early 1980s. Only by synthesising both parts of this analysis can we comprehensively approach the question of the type of mediative promise that the Jesuits developed regarding the ETA conflict.

    Resumen
    Following the great fragmentation in the Arab world today as well as the problematic de-colonization phase, it would be relevant to investigate whether Arab-Islamic Egyptian revivalism has been truly capable of shaping a counter-hegemonic narrative against western colonialism and post-colonialism in the 20th century. Can we consider Sayyid Qutb¿s political and religious analysis, as well as his formative background, a concrete counter-hegemonic narrative? Was the narrative of Rashid Rida and Hasan al-Banna solidly based on religious Islamic concepts and meanings? The main aim of this article is to reconsider the contemporary understanding of Islamic Egyptian thought in relation to Buruma and Margalit¿s proposed Occidentalism methodology, on the one hand, and the Hegemonic-counter-Hegemonic debate, on the other.

    Resumen
    Los estudios sobre la imagen de España en tiempos de la Ilustración han subrayado, casi siempre, el papel de los escritores no españoles (y, en especial, de los philosophes) en la relegación de lo hispano a los márgenes de la modernidad. Lo cierto es, sin embargo, que, en el siglo XVIII, la idea de España como opuesta a la Ilustración y al progreso fue asumida sin apenas controversia por los mismos españoles. De hecho, los más vehementes apologistas de España fueron quienes más se empeñaron en presentarla como una nación intolerante y poco dada a la ciencia, el comercio y la industria. Estos apologistas pretendieron combatir las opiniones antihispánicas de Montesquieu, Voltaire y compañía, pero subrayaron tanto o más que ellos la radical oposición entre España y la modernidad ilustrada. Así, paradójicamente, los grandes defensores de España, de sus instituciones, de su historia y de su genio nacional contribuyeron como pocos al éxito de la llamada leyenda negra.

    Resumen
    O paralelo entre questões contemporâneas e história romana muitas vezes fascina e ilumina. Neste artigo, argumento que o direito romano, que foi uma das várias fontes de inspiração para os fundadores americanos, pode servir hoje como uma inspiração para o constitucionalismo global. Olhar para o direito romano ajuda a reduzir certos preconceitos derivados do atual privilégio do Estado soberano e do paradigma positivista como os únicos modelos genuínos e possíveis para o direito internacional. Esses preconceitos constituem um verdadeiro obstáculo ao desenvolvimento correto do constitucionalismo global. O constitucionalismo global se move inerentemente para além da soberania, do nacionalismo e do positivismo. O direito romano, que precedeu às noções de soberania, nacionalismo e positivismo, permite aos constitucionalistas eliminar do constitucionalismo global quaisquer elementos não fundacionais derivados de um paradigma altamente estatista. A lei romana também constitui um bom antídoto para qualquer tipo de constitucionalismo global extremo que busque estender a linguagem e os modos do constitucionalismo nacional sem filtrá-los e refiná-los suficientemente.

    Resumen
    In a 2015 article entitled ¿The Irrelevance of Ethics,¿ MacIntyre argues that acquiring the moral virtues would undermine someone¿s capacity to be a good trader in the financial system and, conversely, that a proper training in the virtues of good trading directly militates against the acquisition of the moral virtues. In this paper, we reconsider MacIntyre¿s rather damning indictment of financial trading, arguing that his negative assessment is overstated. The financial system is in fact more internally diverse and dynamic, and more reformable, than suggested by MacIntyre¿s treatment. The challenge at the heart of MacIntyre¿s claims can be crystallized in the question, ¿under which conditions, if any, can a person be an effective trader and simultaneously live a worthy human life?¿ We conclude that there are realistic possibilities of integrity and growth in moral virtue for those who work in the financial sector, at least for those operating in a work environment minimally permissive toward virtue, provided they possess characters of integrity and genuine aptitude for the skills and attitudes required in their professional tasks.

    Resumen
    La impotencia es, en derecho matrimonial, aquel defecto congénito o sobrevenido que imposibilitaba el acto sexual entre la mujer y el hombre y hacía nulo el matrimonio. Su razón de ser tiene una conexión directa con la naturaleza y los fines de la institución matrimonial. El artículo estudia este impedimento en la legislación y los tratados doctrinales de Hispanoamérica entre los siglos XVI y XVIII. Se presta atención a las diversas clasificaciones y síntomas de este impedimento, a la ciencia médica del momento y a los diversos supuestos que tienen incidencia en él, como el caso de los impúberes, los hermafroditas y los afectados por maleficio. Se tratan también los aspectos procesales de la declaración de nulidad por impotencia.

    La historia global responde tanto a la superación de fronteras por medio de estudios transnacionales como a la posibilidad de eludir visiones occidentales que reduzcan la complejidad de los problemas de fundamento histórico. En este monográfico, dedicado al estudio en perspectiva histórica de la relación entre élites, sociedad y educación, reivindicamos una historia global que no desatiende lo local, sino que tomando como referencia aspectos concretos de contextos bien definidos los amplia a escala nacional, continental o transoceánica. Se incluyen igualmente estudios de caso que analizan las actuaciones de agentes históricos cuyo comportamiento responde también a fenómenos globales. El monográfico se estructura a partir de dos epígrafes centrales: a) Educación y procesos de civilización de las élites vascas y navarras en la monarquía hispánica (XVIII - XIX) b) Retos transnacionales de la educación jesuítica: acomodación italiana ¿ adaptación británica ¿ integración europea (XVIII/XIX - XX). Asimismo quedan integrados dos artículos que abordan desde perspectivas historiográficas diferenciadas y contextos diversos la temática que relaciona élites y la educación.

    Resumen
    This paper aims to emphasize the influence that ¿Classic¿ Islamic Thought had on the contemporary European-Islamic one regarding the conceptualization and action of emigration (hijra-hajara) through the geographical and juridical redefinition of the Old Continent as a new ¿house¿ (dar/bayt) in hosting a Muslim population. The analysis should also be considered in relation to the sectarian and violent phase which followed the peaceful one of the so-called ¿Arab Spring¿ and the current deflagration of part of the Middle East. During the proto-Islamic historical phase, the term muhajirun was adopted to define those who made the hijra, referring to the prophet Muhammad¿s followers in 622. They aimed to live according to religious behaviour and started to be different from their polytheist society of origin; the same term was also used to categorize those who partially populated the new conquered territories in the following decades: Syria, Egypt, Mesopotamia, the Iranian plateau, etc., and who decided to take root and become in-urbanized. The contemporary juridical, political, and religious perception, before and after 2011, started to consider a different ¿emigration¿ perspective, which, not so differently from the original hijra conceptualization, is rooted in abandoning a land of warlike and sectarian violence to reach a geography where individual religious affiliation can be safeguarded.

    Resumen
    This article focuses on the process of rapprochement between Spain and Europe in the years after Spain's political transition to democracy and prior to its formal entry into the European Economic Community in 1986. It looks deeply into a concrete case at the regional level, namely the steps taken on the path towards European integration in the Basque Country with the founding of the Instituto de Estudios Europeos at the University of Deusto (Bilbao). The European issues taught at the Institute centered on technical and administrative elements, contributing to the education of a rather functional elite capable of responding to practical needs related to Spain's European integration. This article will first analyze the perspective of the Institute's founding-director, Basque-Navarre jurist and politician Juan Churruca Arrellano, looking into his intellectual socialization, as well as his idea of Europe. In this respect, Churruca followed an Ortegian conception of Europe, that is, a historical and cultural understanding of Europe very present in Spain's intellectual, cultural and political elite during that time. Furthermore, this study delves into the immediate political-historical context surrounding the Institute's foundation, paying particular attention to the relationship between Churruca and the University of Deusto in terms of national and regional politics. Finally, in the conclusion, this paper outlines an answer to the question of how the Instituto de Estudios Europeos contributed to Spain's initial European integration.

    Resumen
    Since the late 20th century, the posthumanist project of human improvement has been proposing the overcoming of the actual human capacities. Although this possibility may not yet be in practice, these hypotheses have emerged in the genre of science fiction resulting in the collective image of what is considered to be possible, even desirable. Moreover, science fiction experiments with these artificial developments up to the greatest extent and provokes a questioning of the matter. In the present study, the tensions relating to posthumanism in the fictional series Westworld are reviewed. The article focuses particularly on identity, one of the most fluctuating concepts of present day. The analysis reveals the need to approach `identity¿ from a point of view that shows the special importance of personal experience, both from the corporal and psychological point of view

    Resumen
    In this article, I explore potential connections between law and spirituality as well as some of the legal implications of these connections. After arguing that spirituality is conceptually autonomous from religion and morality, I explain why the spiritual triad of love, communion, and gift is deeply interconnected with the legal triad of justice, agreement, and right. I also make clear why individual and collective intentions and cultural values are the main channels of interaction between law and spirituality. In the second part of the article, I argue that legal systems evolve through spiritualization, among other ways, promoting the dematerialization of the legal system, encouraging the limitation of domination, inspiring the reduction of coercion, stimulating communion and consensus in society, or increasing respect for the law and the legal systems. Spiritualization demands a recognition of the higher dimension of the law and, therefore, helps rethink, reorient, renew, reform, and reimagine law and legal systems. Finally, I sketch a pattern of five levels to measure the degree of spiritualization of concrete legal systems. This pattern can also be applied to legal actors and institutions.

    El afán de dar prioridad temporal al nacionalismo liberal sobre el nacionalismo reaccionario ¿y, más en concreto, de afirmar que el «nacionalcatolicismo» no surgió hasta la segunda mitad del XIX¿ ha llevado a la historiografía reciente a asumir las siguientes ideas sobre el discurso «servil»: 1) que se oponía a los Bonaparte por motivos religiosos y no patrióticos; 2) que era férreamente absolutista y no otorgaba ningún papel a la nación en sus esquemas políticos; 3) que rechazaba la palabra «patria» y aún más la palabra «nación»; 4) que, lejos de apelar al pueblo y de identificarse con él, lo temía profundamente; 5) que no invocó a los héroes de la patria ni elaboró un relato histórico nacional opuesto al de los liberales; 6) que no esgrimió la idea de la «antiespaña»; y 7) y que, si bien dio muestras de xenofobia, no exaltó la propia identidad nacional. Sin entrar en la compleja cuestión del origen y los rasgos esenciales del nacionalismo contemporáneo, este artículo pretende demostrar que los textos escritos entre 1808 y 1814 por los reaccionarios españoles contradicen claramente estas asunciones historiográficas.

    Resumen
    The discussion in 1844 of a draft law on secondary education gave rise to a broad debate in France about the content and scope of the freedom of education ordained by the Constitution of 1830. In opposition to those that defended the monopoly of the University or its absolute liberalization, Tocqueville was in favor of a regulated freedom. However, beyond the concrete debate of the law, what was at stake was the place reserved for the Church in the new constitutional order implemented by the July Monarchy. La discusión en 1844 de un proyecto de ley sobre instrucción secundaria dio lugar a un amplio debate en Francia sobre el contenido y alcance de la libertad de educación consagrada en la Constitución de 1830. Frente a las posiciones extremas que defendían el monopolio de la Universidad o su liberalización absoluta, destaca la postura de Tocqueville favorable a una libertad regulada. Sin embargo, más allá del debate concreto de la ley, lo que se hallaba en juego era el lugar reservado a la Iglesia en el nuevo orden constitucional implantado por la monarquía de Julio.

The crisis of the Catholic Church caused by clergy sexual abuse of minors has revealed, among other things, the widespread well-intentioned but naive inclination to resort to penal law as opposed to any theology of mercy and forgiveness. Although the author argues that penal law has a proper place in the Catholic Church, he considers that in a voluntary community that shares a homogeneous system of moral values without strong penalties involving deprivation of liberty - a community like the Catholic Church - moral and administrative sanctions could be more effective than penal sanctions. A distinction between administrative sanctions and penal sanctions, and therefore between administrative tribunals (should they be established) and penal tribunals, is highly recommended.

Esta iconografía fue introducida a finales del siglo IX con el objetivo de paliar los efectos simbólicos de la intervención eclesiástica en la ceremonia de la coronación, analizada en el artículo del número anterior. El motivo iconográfico de la ¿coronación celeste¿ es deudorade la iconografía específica de la Manus Dei, desarrollada durante la época tardoantigua.

    Resumen
    Multifaith buildings have become common in Europe, North America, and much of the world, but they have yet to receive sufficient scholarly attention in the history of religious ideas, or in the theory of material religion. This paper begins to address this lacuna by the consideration of an early, but little known, multifaith chapel donated to Somerville College Oxford in the 1930s, which is unique within Oxford University. Its history, architecture, and artworks give valuable insights into the religious, intellectual, and cultural roots of what would subsequently become a global norm. The chapel can be seen as both a manifestation of the aspirations of liberal Christianity in the interwar years, including the advancement of women and ecumenism, and of the contestation of the role of religion in higher education among elites in the same period. Examining the case of Somerville chapel contributes to the theory of religion by considering how unbelief and multifaith ideas may be attempted to be materially expressed, and how this physical presence subsequently may impact on institutions and people through ongoing contestation, and negotiated use.

    Resumen
    The transition of Sacred Scripture from a supernatural text to a mere secular text can be related to the Reformation, but we cannot say that it was the work of the protestant Reformation. Moreover it was the result of the enlightened biblical criticism practiced by some philosophers, as is the case of John Locke. Locke's work contributes to the construction of the "Academic Bible" as opposed to the "Biblical Scripture". In his writings we can detect a kind of dialectic between the supernatural character of the Sacred Scriptures and the consideration of reason as natural revelation that leads to some paradoxes. Because of that the literature has considered Locke's position, as been alternatively Calvinist, Arminian, Socinian, Latitudinarian or Unitarian. This article deals with these paradoxes and evaluates the original Lockean thesis on Biblical interpretation, which is inseparable of his faith, his epistemology and his theory of language.

    Resumen
    This article explores potential applications of the body-soul-spirit metaphor in the legal realm. After a justification of the validity of the metaphor as a source of legal meaning, and an explanation of the trichotomy body-soul-spirit in the light of St Paul's letters and Edith Stein's writings, the author focuses on some current debates in which the use of the metaphor sheds new light. Based on this metaphor, the author argues for the respect of the law as a whole; the use of the spirit of foreign law by national legal systems; the living character of the constitutional body; the emergence of a global law founded on solidarity and not on the self-interest of nation states; the intrinsic link between law and love; and the reasonable interaction between human law and supra-rational (or divine) law.

    Resumen
    Surprisingly, mainstream histories of biblical exegesis, such as Frei's or Reventlow's, usually disregard Hegel's approach to biblical interpretation. However, some of Hegel's epigones, such as Strauss, Bauer, Vatke, or Baur, were influential in the history of exegesis. This article aims at highlighting the relevance of Hegel's exegetical writings for the construction not only of the "philosophical Bible"-that is, in my own terminology, the interpretations of the Bible made by philosophers-but also for the biblical exegesis made by theologians. Beyond the place that his commentaries on the Scriptures occupy in his Philosophy of Religion, Hegel's exegesis has exerted influence over biblical exegesis and philosophy, particularly hermeneutics.

    When we think in terms of the durability of historical texts, some works instantly come to mind: Herodotus's, Thucydides's, and Polybius's war narratives, Plutarch's comparative biographies, Eusebius's ecclesiastical history, Augustine's City of God, Jean Froissart's chronicles, Francesco Guicciardini's history of Florence, Edward Gibbon's Decline and Fall of the Roman Empire, Jules Michelet's History of France, Leopold von Ranke's History of the Reformation, Jacob Burckhardt's The Civilization of the Renaissance in Italy, Johan Huizinga's The Waning of the Middle Ages, Fernand Braudel's Mediterranean, and Edward Thompson's The Making of the English Working Class, among others. Historians instantly perceive them as durable texts, part of a canon of history and historiography. Surrounded as we are by the exaltation of innovation over tradition, and assuming the challenging concept of "writing as historical practice" proposed by the editor of this issue, In this article I examine the conditions that might be considered necessary for historical writing to achieve durability, propose what conditions of creation and reception enabled this longevity, justify why these and other historical texts have the potential for durability, and discuss what practical lessons we might obtain from this inquiry. I begin by making some distinctions among the three related concepts of durability, the classic, and the canon, and try to establish the specific conditions of the durability of historical texts, focusing on the effect of contemporaneity and the connections between the concepts of durability and the practical past.

    The thesis I wish to defend here, albeit in a preliminary manner, is threefold. First, I argue that if we go along with the myth of popular sovereignty and accept that the governmental functions of a political community are comprehensive or nearly comprehensive in their scope and are exercised by one agency on behalf of the whole people, then the ideal of popular self-government does as much to obscure as illuminate our understanding of governance processes in the real world. Second, I contend that the myth of the sovereign, self-governing people, besides constituting a misleading representation of social and political reality, has highly undesirable practical consequences as a political ideology; in particular, it suppresses or inhibits many forms of associative freedom that do not fit within the boundaries of the sovereigntist narrative. Third, I suggest that if we are willing to rethink self-government in a polycentric, consociational manner, and conceptualize the national community as united by a shared commitment to basic norms of civility and justice rather than by submission to a putatively `sovereign¿ government or state, then we can recover a more empirically workable and normatively attractive concept of the self-governing people.

El autor justifica la elaboración de Genealogía de Occidente en la falta de "autoestima" que está presente en muchos occidentales del día de hoy. La cuestión que hay detrás de ello es obvia: sin duda, la importancia de ser veraz consigo mismo -y no sólo con los demás- es un rasgo de la civilización occidental, y eso supone la autocrítica y, sin demasiado esfuerzo, la reflexión sobre si los propios occidentales han sido coherentes en sus hechos con sus razones. En un segundo paso, surge el problema de si el fomento de la reflexión y de la libertad de expresión, tal como se entienden en Occidente, no generan un complejo de culpabilidad respecto a su cultura, que se basa, precisamente, en el alcance que ha supuesto el fenómeno histórico que llamamos "occidentalización".

    Las embajadas de prestación de obediencia constituyen el gesto de pleitesía más solemne que un príncipe podía otorgar al romano pontífice desde fines de la Edad Media. A pesar de su importancia, son escasos los estudios dedicados a esta ceremonia que cobró particular auge durante el reinado de los Reyes Católicos a raíz de sus relaciones con Roma. Con Julio II no fue tan sencillo, y aquel acto se retrasó más de tres años, hasta que en abril de 1507 Fernando II de Aragón envió su obediencia aprovechando la estancia en el reino de Nápoles. Se trataba de un momento especial del reinado, en que el monarca quiso cerrar la pasada crisis sucesoria (1504-1506) apuntalando su política italiana con un nuevo entendimiento con el papado. Describir el desarrollo ceremonial de la legación aragonesa, y analizar sus principales temas de negociación son los objetivos de esta intervención, que pretende iluminar un evento desatendido por la historiografía y necesitado de una renovación interpretativa y documental.

    This article presents an excursus on the historical reasons for the absence of a concrete anti-Christian narrative before religious clashes blew up in the Arab Levant during the 1850s and 1860s and which affected in particular the towns of Aleppo and Damascus. Recent secondary sources (Bat Ye¿or, A. G. Bostom) consider these 19th century early inter-religious fights the first steps of an Islamic contemporary ¿supremacist¿ discourse which has increased the inner region disputes. This study underlines the reasons why this more recent interpretation has little basis on the historical side as on a terminological discourse.

    Since the 1970s and 1980s, Business Ethics has been studied and taught. This Ethics is usually ¿pragmatist¿ or ¿deontological,¿ but it can also be ¿realistic.¿ Ethics is part of Philosophy, which was classically called ¿love of wisdom,¿ but that definition and ethics itself changed since Early Modernity. Realistic Business Ethics ¿ inspired by Aristotle and St. Thomas ¿ has a metaphysical ground that highly differs from the modern metaphysical one. Associated with the ¿science of man¿ and the truth conceived as ¿something useful,¿ this metaphysics is con- ceived as pragmatist. Anthropology and economics ¿ considered as social sci- ences ¿ were born with Modernity and Enlightenment, respectively, in a context of changing philosophical paradigms but have gained prominence since the nineteenth century. Our aim is to briefly explain who are the authors and the key points that made this change possible. This illustrates the new way of understanding the man and his action from a moral and social perspective. With Montaigne and Descartes the science of truth is left behind as the science of man gains more attention. This implies that contemplation is substituted by a technical action of one self who knows itself as a free and individualist actor (subject) with own interests and passions. In Descartes we find the traits of the new wise man, what is his method, and how metaphysics, anthropology, and ethics are now articulated, that is, how and why this change from a contemplative wisdom to a pragmatic one occurred.

    Firmly rooted on Roman and canon law, Italian legal culture has had an impressive influence on the civil law tradition from the Middle Ages to present day, and it is rightly regarded as "the cradle of the European legal culture." Along with Justinian¿s compilation, the US Constitution, and the French Civil Code, the Decretum of Master Gratian or the so-called Glossa ordinaria of Accursius are one of the few legal sources that have influenced the entire world for centuries. This volume explores a millennium-long story of law and religion in Italy through a series of twenty-six biographical chapters written by distinguished legal scholars and historians from Italy and around the world. The chapters range from the first Italian civilians and canonists, Irnerius and Gratian in the early twelfth century, to the leading architect of the Second Vatican Council, Pope Paul VI. Between these two bookends, this volume offers notable case studies of familiar civilians like Bartolo, Baldo, and Gentili and familiar canonists like Hostiensis, Panormitanus, and Gasparri but also a number of other jurists in the broadest sense who deserve much more attention especially outside of Italy. This diversity of international and methodological perspectives gives the volume its unique character.

Rialp, sin embargo, ha cruzado del siglo XX al XXI con sus rasgos esenciales en continuo desarrollo, a pesar de las crisis que debió superar, ninguna de ellas leve. Estos tres personajes fueron precisamente los protagonistas de la primera gran crisis, en la cual estuvo a punto de desaparecer la editorial.

    This chapter explores the relevant role played by Robert Schuman (1886¿1963) in the processes of European integration, and his potential contribution to the idea of global law. Schuman believed in an organized and united Europe based on the leadership of Germany and France, acting as two powerful lungs under equal rights with other nations. The heart of Europe should be, however, Christian in character, because Christianity is, according to Schuman, the true inspirational source for forgiveness and love. He embodied and anticipated the values that Europe should develop politically: diversity, solidarity, forgiveness, magnanimity, and generosity. In this sense, Robert Schuman was the first citizen and founding father of the European Union. In all of his political ideas and actions, he was guided and determined by his religious attitude. Out of his Christian outlook, he understood politics as a service to humanity, oriented to the common good, and in harmony among individuals and peoples. Since both the European community and the global community are incomplete and complementary, some analogies based on Schuman¿s approach to Europe can be established in the development of a theory of global law.

    This book explores both historical and contemporary Christian sources and dimensions of global law and includes critical perspectives from various religious and philosophical traditions. Two dozen leading scholars discuss the constituent principles of this new global legal order historically, comparatively, and currently. The first part uses a historical-biographical approach to study a few of the major Christian architects of global law and transnational legal theory, from St. Paul to Jacques Maritain. The second part distills the deep Christian sources and dimensions of the main principles of global law, historically and today, separating out the distinct Catholic, Protestant, and Orthodox Christian contributions as appropriate. Finally, the authors address a number of pressing global issues and challenges, where a Christian-informed legal perspective can and should have deep purchase and influence. The work makes no claim that Christianity is the only historical shaper of global law, nor that it should monopolize the theory and practice of global law today. But the book does insist that Christianity, as one of the world¿s great religions, has deep norms and practices, ideas and institutions, prophets and procedures that can be of benefit as the world struggles to find global legal resources to confront humanity¿s greatest challenges.

El prelado superaba entonces los 60 años y acumulaba una rica experiencia al servicio del Papado y de la Monarquía sin la cual resulta difícil explicar su acción durante el torbellino revolucionario. En el presente trabajo abordaremos una de sus facetas menos conocidas: su pasado curial y diplomático en Roma a lo largo de cuatro pontificados sucesivos, entre 1484 y 1507, como oficial del vicecanciller Rodrigo de Borja ¿luego Alejandro VI¿, y como embajador de Felipe de Habsburgo, rey de Castilla. Lo haremos gracias a la documentación inédita procedente del Archivo Secreto Vaticano, los Archivos departamentales de Lille y otros fondos españoles que hemos consultado gracias a la colaboración de archiveros y especialistas sin los cuales esta investigación no hubiera sido posible . Con ello arrojaremos nueva luz sobre el pasado romano de Acuña para comprender mejor su posicionamiento político-eclesial en el movimiento comunero y su protagonismo en la crisis dinástica que sacudió a la Monarquía Hispánica tras el fallecimiento de Isabel la Católica.

    In this book, Marco Demichelis explores the history of the concept of jihad in the early proto-Islamic centuries (7-8th). Deploying an interdisciplinary approach which combines the hermeneutical study of the famous 'Verses of the Sword' within the Qur'an itself, with historical writing by Islamic chroniclers as well as non-Islamic sources, numismatics, epigraphical and architectural evidence, the book questions the relationship between the religious concept of jihad and the conquests. The book argues that Christian Byzantine Foederati forices who previously fought against the Persians may have had a formative effect on the later emergence of more bellicose rhetoric. In so doing, it calls into question assumptions about warlike attitudes inherent within Islamic doctrine, and reveals a more nuanced and complicated history of religious violence in the pre, proto and early Islamic period.

    Firmly rooted on Roman and canon law, Italian legal culture has had an impressive influence on the civil law tradition from the Middle Ages to present day, and it is rightly regarded as "the cradle of the European legal culture." Along with Justinian¿s compilation, the US Constitution, and the French Civil Code, the Decretum of Master Gratian or the so-called Glossa ordinaria of Accursius are one of the few legal sources that have influenced the entire world for centuries. This volume explores a millennium-long story of law and religion in Italy through a series of twenty-six biographical chapters written by distinguished legal scholars and historians from Italy and around the world. The chapters range from the first Italian civilians and canonists, Irnerius and Gratian in the early twelfth century, to the leading architect of the Second Vatican Council, Pope Paul VI.     Juan Claver fue embajador de los Reyes Católicos durante las «Guerras de Italia» que transformaron la Europa del Renacimiento e impulsaron la diplomacia moderna. Su misión en el ducado de Milán y el reino de Nápoles permitió el despegue diplomático de la joven monarquía hispánica en un escenario desestabilizado que polarizó su acción exterior. El presente libro reconstruye por primera vez la trayectoria de este personaje que, tras su paso por la administración regia, se desplazó a Milán para asegurar la amistad de Ludovico Sforza (1495-1498), y después marchó a Nápoles para asistir a Federico de Aragón y colaborar con el Gran Capitán en la conquista del Regno (1499-1504). El estudio cuenta con cuatro apartados, precedidos por una presentación metodológica que evidencia su novedad interpretativa y documental. Tras la biografía de Claver, se abordan las misiones diplomáticas a través de su inédita correspondencia, conservada en diversos archivos europeos y editada ahora. Esta documentación arroja nueva luz sobre los vínculos entre los Reyes Católicos y la corte sforzesca bajo la Liga Santa, y esclarece la extinción de la dinastía aragonesa de Nápoles a raíz del conflicto hispano-francés.     This book explores both historical and contemporary Christian sources and dimensions of global law and includes critical perspectives from various religious and philosophical traditions. Two dozen leading scholars discuss the constituent principles of this new global legal order historically, comparatively, and currently. Algunas son muy conocidas pero existen otras que participaron sin saberlo en ese movimiento imparable y progresivo hacia la ampliación del espacio público femenino. Gracias a ellas, por ejemplo, en 1910 las chicas españolas pudieron entrar oficialmente en la Universidad. Como este grupo de jóvenes, han existido otras mujeres que por sí solas, por entender que era lo natural, estudiaron, sacaron adelante iniciativas sociales de carácter profesional, ejercieron en el sector para el que se habían formado... Con ello estaban abriendo las puertas y dando ejemplo a otras muchas mujeres que quizá no se habían planteado tales posibilidades. Tal es el caso de Guadalupe Ortiz de Landázuri.

    Religious violence due to political reasons has been a common practice since ancient times: The massacres of early Christian communities, carried out by the Roman Empire, were rapidly replaced by equally harsh measures against non-Christian believers, being accused of abominable and polytheistic practises. The advent of the modern age, the homogenization of the religious sphere for political-economic ends, the annihilation of any kind of heresy and the emergence of Protestantism, Calvinism and Anglicanism restructured the conceptualization of the Western European States emphasizing the adage 'one kingdom, with one religion and one nation'. The end of the religious wars (1648), the Westphalian sovereignty and the Cuius Regio Eius Religio had an impact on the formation of Europe and other regions, the Franco-British colonialism imposed the same system on the entire Middle Eastern and Islamic World. This volume thoroughly examines the usage of inter-religious violence, religious sectarianism and Islamophobia on a theoretical basis, linked with 'Clashes of Civilizations' and 'Religious Nationalism', and describes them as manifestations of precise political ends, aiming to preserve fragmentation and warlike states in the East as well as fear and prejudices in the West.
